In the recent fraught working climate the late payment of accounts from one enterprise to another could be more opten, but for the small businesses that are owed money by the larger businesses, the small enterprise could well be put in a difficult position. On the one hand they need the invoices to be paid, but they also have to keep a good relationship with the larger enterprise, especially if the small enterprise has had many contracts or provided products on many occasions to the same larger enterprise, they want this flow of work to carry on. The small enterprise could feel that their only choice is to seek out a conventional Debt collection answer to this difficulty, perhaps a solicitor who specialises in Debt collection or a Debt collection agency. Both of these should be able to create convincing Debt collection letters that might get the larger enterprise to settle the account, but there could be a chance of them looking at this approach as rather abrupt, rather than asking the larger enterprise for their side of things first. This could make the larger enterprise think twice before selecting that small enterprise for products or services that it requires in the future. This could harm the professional standing of the small enterprise in the business area that it operates in and so they could lose further orders by having the direct approach taken on their behalf.

The best way to take care of the unpaid account would be for the small enterprise to hold off the Debt collection activity and to get in touch with the larger enterprise and find out their side of the situation, they could have internal issues that have caused problems with their invoicing procedure or they could also be have outstanding payments from even larger businesses that have disrupted their normal cash flow pattern. By communicating in this way it shows the larger enterprise that the small enterprise is considerate as well as ethical and professional in its business dealings, rather than only adopting a Debt collection path right away. However it could be that the larger enterprise has put forward a problem scenario, but could in fact be simply trying to get as much interest on its money and wait till the last minute to clear outstanding accounts. This is just like treating the small businesses as free credit agencies, and if it were publicised it could harm the professional standing of the larger enterprise. However it is likely that the small enterprise has to go along with the larger companys point of view, but the small enterprise could well need to have a reserve plan, in this situation it could be best to investigate Debt collection software that can provide enough of tuition on generating Debt collection letters and also tuition on how the Debt collection activity works so that they are able to confidently know when it is best to send out the Debt collection letters. The Debt collection software needs to have the functionality to refister key happenings on the Debt collection activity such as when Debt collection letters are sent out, when documents, emails or payments are received and when phone calls are made and received. Such calls my also need to be recorded if possible or otherwise typed up and stored as electronic documents in the Debt collection software database. This database is essential if the small enterprise finds that the Debt collection letters have not had the desired result and now they are considering taking the larger enterprise to court. The court will need to see evidence that the small enterprise has made serious efforts in the Debt collection activity before they will allow the case to be heard.

In the present economic climate and when financial institutions are still reluctant to lend finance to small organisations it might come as no surprise to discover that small organisations have to wait longer for invoices to be paid for projects done or items supplied to large organisations. It might be that the large enterprise is itself waiting for its own invoices to be paid, or it could be that they simply want to keep hold of their cash for as long as possible. While the small enterprise might appreciate the difficulties that the economic climate is causing to most organisations, their own difficulties will be their first priority and so they will want to press the large enterprise to pay the invoice. They might see a court case as one direction but this might become expensive especially if there is no guarantee of winning and being awarded costs from the large enterprise, so this may well be seen as a last resort to be used only when all other Debt collection operations have failed.

The first move that the small enterprise should make is to get in touch with with the large enterprise and find out why the invoice has gone over its final date for payment. The reply from the large enterprise might well decide the next move for the small enterprise, but they ought to be conscious of the fact that they will have to make efforts in Debt collection before they will be granted consent to go to court, so they might as well make the effort and try and recover the debt. The small enterprise might well look for the most economical direction for Debt collection and so the charge of some 10% or more of the outstanding debt, which is levied by legal practices or Debt collection businesses, might seem rather high when the small enterprise has a low cash flow. Debt collection software however, can be had for under £100 and this can become an economical way for the small enterprise to carry out the Debt collection procedure internally. The small enterprise ought to evaluate Debt collection software packages carefully, paying attention to the Debt collection letters side as these form the centre of the Debt collection procedure since they show interaction between the parties, which might well be crucial if the case goes to court.

A good Debt collection software package ought to give the user a good comprehension of the Debt collection procedure by the use of documentation or on-line education. The best way to create Debt collection letters ought to be explained, while by the supply of examples of Debt collection letters appropriate to each stage of the Debt collection procedure, the small enterprise ought to be able to create their own, customised Debt collection letters. The small enterprise will need to allow for resources being essential for the Debt collection software, such as one or more persons to run the system, a suitable PC to install the Debt collection software onto and a printer to print hard copies of the Debt collection letters. The Debt collection procedure should be a part-time procedure for the small enterprise so the employees aspect might not be so bad and of course if they need to manage future Debt collection they are already set up with no further cash to pay out.

By using employees with a good standard of English and the training from the Debt collection software set of instructions, it is hopeful that the Debt collection letters will persuade the large enterprise to pay the invoice and not to delay payment in the future and so a court case ought to be avoided.

In the current financial situation, when a small firm has been delivering services or goods to a large firm on many occasions, it may be a surprise when their last account has not been settled by the agreed last authorisation for payment date. If the large firm has kept up a good payment record in the past then the small firm may feel that they have a good enough working relationship that they don’t want to damage by going straight into Debt collection processes and sending out Debt collection letters. If the small firm has a late authorisation for payment clause in their terms and conditions then they ought to apply this, but do it in an ethical and professional way, also keep the large firm informed of what they are going to do as this should not damage the working relationship.

It may be that the small firm has not had to handle Debt collection in the past and may now need to see what their choices are. While they may be happy with sending accounts and then a reminder for a late payer, they may be less happy with composing Debt collection letters. In any business decision, there are many factors but finance will always be one of the crucial factors and in the Debt collection world the financial outlay can vary dramatically between the various choices. There are three significant choices for Debt collection; a legal practice who specialises in Debt collection, a Debt collection company with commercial skill and finally, Debt collection software. The first two choices allow the small firm to hand over the Debt collection procedure to a third party, while the third option brings the Debt collection procedure in-house. As may be expected the financial outlay associated with the three different choices are very different as the legal practice and the Debt collection agencies will normally set theircharges as a percentage of the debt which may equate to be a significant sum, although some may offer a no win no fee deal. On the other hand the Debt collection software may well cost under £100. The major difference here in cash terms is that the legal practice and Debt collection agencies would invoice for every future Debt collection they were asked to manage, whereas the Debt collection software is one off purchase and so would only need running costs such as paper, printer consumables and postage costs.

The Debt collection software would also generate a cost in people terms since a person would need to be dedicated to use the Debt collection software, at least as one aspect of their work load. The small firm may feel that a second person who could be trained up would provide cover for sickness, holiday or other absence, all taking time away from their normal activities. The fundamental part of Debt collection is to compose convincing Debt collection letters, which the legal practice and Debt collection agencies ought to be comfortable with, while to compensate, the Debt collection software must provide a set of instructions and examples of Debt collection letters. The Debt collection software ought to advise the small firm of the requirement for a plan of action and in this context there ought to be examples of Debt collection letters that are appropriate for each stage of the plan. The small firm may need to tailor the Debt collection letters around any late authorisation for payment clause in their terms & conditions so that they look correct to the large firm.

When a small business has sent their invoice for jobs done or goods supplied to a larger business and then realise that it has not been settled after the agreed final settlement date, they may wonder if there is anything in the legislation that can help them. For business to business debts such as this, there is the “Late Payment of Commercial Debts (Interest) Act 2002”, which details one off payments and daily interest that the small business is permitted to charge on the late debt. This law is only applied when the contract, agreed between both businesses, does not have a late settlement paragraph, if it does, then the law cannot be applied as well. The small business has the choice of applying the charges or not however the large business cannot opt out of the late payment law.

If the small business has to keep working or supplying goods to the large business then before applying any charges they should notify the large business what they are proposing to do. In addition it is good to send a revised invoice showing the charges being made so that it is clear what is being charged for. If making use of[/spin] the law does not prompt settlement by the large business then the small business may see it as appropriate to begin Debt collection proceedings. This can be done by several ways; a Debt collection business, which specialises in commercial Debt collection, or a solicitor with similar specialisation, or even to get of a Debt collection software package and keep the Debt collection process internal.

Retaining the Debt collection process internally can not only save revenue, but also enable the small business to control the Debt collection process. To allow them to do this effectively the Debt collection software should include documentation which explains the Debt collection process in detail and most importantly, how to generate convincing Debt collection letters. The small business will also need to allow for sufficient resources if this strategy is to work and so competent employees should be picked, perhaps two or more so that there is support in the event or holidays, sickness or other absence. Computer knowledge would be a very useful requirement and also a good standard of English in order to generate good quality Debt collection letters. The Debt collection software should be able to pull the user along the Debt collection process and show them how to generate Debt collection letters suitable for different levels of the process. A good way of doing this would be to include a suite of templates of Debt collection letters so that the user has a starting point from which they can customise the actual Debt collection letters to suit the large business details, which will be essential if the Debt collection letters are to be taken seriously.

A really good benefit of Debt collection software is that once bought it can be reused for any debts that come up in the future and the small business only has to pay for printer consumables, stationery and postal costs. It the small business was to use a solicitor or Debt collection business then they may well be required to pay 10% or more of the debt for the service, but this would be asked for for any future debts as well, so making these rather expensive options.

When a small enterprise that has been supplying parts to a large enterprise on many occasions finds out that the latest invoice has not been settled on time and is overdue, the formal strategies of pursuing this debt may be to consult a solicitor, preferably one who specialises in Debt collection, or to use a Debt collection firm and let them take on the Debt collection on the small enterprise’s behalf. However by undertaking a strategy like this straight away the small enterprise may put the professional relationship they have grown with the large enterprise at risk and may not only threaten future orders but may harm their standing in the wider business community. Even so, they ought to make some attempt to contact the large enterprise and make them aware of the outstanding invoice and stress what it means to the small enterprise. If this fails to get the large enterprise to pay the invoice then the small enterprise will need to examine what choices are available to them apart from the formal choices as mentioned earlier. There is surely only one viable alternative, Debt collection software, which the small enterprise can obtain, own and reuse as often as they wish, should future Debt collection crop up.

They will need to carefully examine the market offerings for Debt collection software and try and get a balance between price and functionality. In general, the minimum functionality the small enterprise ought to be looking for are; the ability to write convincing Debt collection letters and the ability to store activities related to the debt in a database, time stamping each happening so as to provide a record of what was done by the small enterprise in the Debt collection operation.

The Debt collection letters are at the heart of the Debt collection operation and must be carefully written if they are to be effective in the Debt collection operation. The Debt collection software needs to provide assistance in creating the Debt collection letters, either by a well written tutorial that takes the user through the operation and explains what they are best putting in the Debt collection letters. In this way the user will be made aware of the ways of building up the Debt collection letters, as well as pointing out the importance of good grammar and spelling. An alternative to a comprehensive tutorial may be the provision of electronic templates for the Debt collection letters, which the user could use as a base for their own Debt collection letters. In this context the record keeping function of the Debt collection software could provide help in permitting the user to bring in details of the debt for inclusion in the Debt collection letters, such as the large enterprise details and the debt value, which may aid in preventing transcription errors that could happen from entering these from a paper document.

By the use of suitable Debt collection software the small enterprise needs to have a good chance of getting the large enterprise to pay the invoice without losing reputation and retaining future orders. The recording of activities by the Debt collection software will be useful in case the large enterprise fails to settle the invoice and the small enterprise decides to take them to court, as this record will show that the small enterprise has made strong efforts in the Debt collection operation already.

For a small organisation cash flow is so crucial, it is really the life blood of small firms. In the current economic climate, especially where the financial institutions seem to have gone back on promises to ease financial support for small firms, they need to have their invoices paid on time as this may well be their only source of funding if bank loans are not available. Where a small organisation has become reliant on a small number of larger firms, they will have most likely built up a good professional relationship with the majority of them and so will want to be careful not to disrupt any of these relationships. With this in mind the best direction for the small organisation may well be to get hold of the large organisation concerned and try and ascertain why the bill has not been paid, in case there has been a simple oversight that can be easily rectified. This should demonstrate to the large organisation that the small organisation is proceeding in an ethical and professional manner and is prepared to take other views into consideration.

If the small feels that the large organisation is using delaying tactics then they may well feel fully justified in using Debt collection methods to try and recover the debt. The risk here is that if they have interpreted the reasoning of the large organisation incorrectly then they may well upset them and find that they get some backlash, which may harm the professional relationship with the large organisation, which in turn could affect their relationship with other of their customers. The options for Debt collection for the small organisation in reality are as follows; a lawyer specialising in business to business Debt collection, a Debt collection company with a similar speciality and finally Debt collection software, which allows the small organisation to take the Debt collection operation themselves. This last option would not only be economical, so essential to the livelihood of the small organisation, but would also give them full control of the Debt collection operation. The writing of Debt collection letters is at the core of the Debt collection operation and the Debt collection software should provide good quality help in this area. This help can be provided by documentation, which should take the user through the various levels of the Debt collection operation, covering legislation such as the “Late Payment of Commercial Debts (Interest) Act 2002” along with advice as to how to write convincing Debt collection letters. Examples of such Debt collection letters for each stage of the Debt collection operation would help the small organisation to become happy with the operation and may provide a quick and successful conclusion to the Debt collection operation. Although Debt collection operation can be bought for under £100, which may well be a cheap price for a small organisation when compared to something like a fee of 20% of the debt that may be charged by a lawyer or Debt collection company, the small organisation need to allocate suitable resources. This will include nominating one or two workers to work on the Debt collection software and write the Debt collection letters, as well as the possibility of a new machine being necessary and may include a printer as well. The running costs should be minimal however, with printer consumables and paper plus postage costs for the Debt collection letters.

If the small organisation people take care in writing Debt collection letters using good English and grammar and avoiding emotional or threatening wording then they should avoid the risk of alienating the large organisation and instead get them to pay the bill.

In situations where a small company has provided services or items to a larger company over a long period of time and has been paid on time in the past, it may come as a shock when the latest bill goes beyond the final payment date. The small company may be thinking about Debt collection procedures, but hopefully they will firstly get in touch with the larger company and try and find out. Their next strategy may be dependant on the outcome of this conversation and if the larger company has been open about having some financial setbacks, possibly from some of their own bills still awaiting settlement, they may well offer a part payment on account. This may be acceptable particularly if both firms are keen to keep their mutual good relationship, and as the larger company have been open and honest about their side of the difficulty the payment on account may be the best temporary amswer.

However, if the larger company does not come up with a suitable reason to the small company, then they may feel that they are being used as a free credit service and not as a trusted supplier. In this situation they may well feel fully justified in exploring their choices for Debt collection, being mindful of the cost question of every choice as the unpaid debt may represent a sizeable part of the cash flow for the small company. The usual choice for Debt collection may be seen as a visit to the solicitor to discuss the problem, but this consultation may have a price to it and suppose the preferred solicitor is not very skilled in Debt collection, the small company may need to look elsewhere. The next logical choice may be seen as a Debt collection company, if there is one in the local vicinity, if not then contact may be by phone and email, by which means it is hard to suss out the professionalism and integrity of the Debt collection company. It is possible that advertised ones are also the latest and may lack experience in Debt collection, so it may be best to try somewhere like Business Link to see if they can recommend a debt collection company. It is probable that the Debt collection company will charge based on the value of the debt and so may be a significant amount.

The small company may also look for Debt collection software so that they can take on the work themselves, but they will need to evaluate Debt collection packages carefully since the quality of the instruction book or on-line help may be their key to learning not only how to run the Debt collection software but how to execute the Debt collection procedure to best effect. Debt collection letters form the key in the Debt collection procedure and the Debt collection software will need to have clear instructions on how to write suitable Debt collection letters for each section of the Debt collection procedure, should the first of the Debt collection letters not prove successful. A slicker solution to clear instructions, or possibly as well as, would be to have the Debt collection software package contain templates or samples of a series of Debt collection letters, so that the small company can use these as a starting point when generating their own Debt collection letters. The Debt collection software will also need to have some sort of database interface so that key activities in the Debt collection procedure can be recorded, such as when Debt collection letters are posted or emailed, registering incoming letters or emails and then permitting reports to be produced that will be useful as evidence should the Debt collection software operation not produce the required results and the large company has to be taken to court.

For a small firm that has been waiting for a larger firm to pay an bill for projects completed, or items supplied, Debt collection by taking the case to court will be a serious action and one which may destroy the working relationship between the small firm and the large firm. This relationship may have been built up over a long period but in the current financial climate, many enterprises may have come up against cash flow issues and may want to get in touch with each other before such a serious step of court action is taken.

Before going along this Debt collection path, the small firm would be best advised to firstly examine the contract for projects or supply of items to the large firm and see if there is a late payment paragraph present. If so then they should still speak with the large firm even if it is only to understand why the payment is late. If the small firm has done a lot of projects or supplied many items over the years to the large firm and this is the first occasion a payment has been late it is only courteous to check to see if there is a issue. It may be that there has been a simple error on the part of the large firm that can soon be put right and payment made.

If on the other hand the talk with the large firm proves unsatisfactory then the small firm may want to begin Debt collection proceedings and if a court case is likely that the court officials will need to see evidence that the small firm has made efforts to resolve the dispute and tried to reach agreement with the large firm. So in the case of gathering evidence of the Debt collection activity a good approach would be to order Debt collection software, which should be able to use a database in which to store records of the key actions in the Debt collection activity. The Debt collection software should also cover the writing of Debt collection letters in some depth, mainly from the legal aspect so that if the Debt collection letters are produced in court, they should be acceptable. Debt collection letters will form the heart of the Debt collection activity and so must be created carefully, referencing any clauses in the contract that are relevant and of course, the Debt collection letters must be created in professional and unemotional terms, otherwise they may well put the small firm in a bad light in the eyes of the large firm. The Debt collection software should provide a set of instructions covering the writing of Debt collection letters so that the small firm feels that they have got a good Debt collection software package.

The Debt collection software should have the facility to register key actions in the Debt collection activity such as the writing and sending of Debt collection letters, incoming letters and emails, and a log of phone calls. All of these actions should be date and time stamped for traceability and the Debt collection software should be able to produce a formalised report of the sequence of actions. It would be hoped that the Debt collection letters would have the wished for effect and encourage the large firm to pay the bill and so end the Debt collection activity, rather that it finishing up in court, where the costs could mount up.

In the present recession, cash flow for enterprises may be difficult, in that if they are owed money for work or sales they will have to consider their options on Debt collection. Do they begin by talking to the debtor company or do they employ the services of a solicitor to pursuefollow up the debtor for payment. A Debt collection agency could offer curiously lucrative deals such as no win no fee, but such agencies may take it that just a minor payment from the creditor is a win and so charge their fee, which may be calculated on the complete debt. Not all Debt collection agencies would work in this way, but would their web sites show this degree of detail and so allow the creditor the knowledge to carry out an informed decision? The other option is to take on the Debt collection themselves by the use of a Debt collection package, consisting of Debt collection software and Debt collection letters. Such packages can be bought from under £50 and organisations who make typical packages would be expected to be able to give complete details of what is in the package and maybe also some idea of the time required to operate the application for a typical Debt collection process. The costs for a solicitor or a Debt collection agency are likely to be on a sliding scale and would generally be based on the debt value, although a solicitor may charge a set fee for the first letter, any further Debt collection letters may be charged extra perhaps.

When operating Debt collection software packages both the creditor and the Debt collection software should be aware of the Late Payment of Commercial Debts (Interest) Act 2002, which was first set up in November 1998 and amended in August 2002. This act permits a creditor to claim both a one-off payment and also interest charges when an account goes overdue. If the creditor has not used this act in the original contract with the debtor, there is nothing in the way of them from implementing the aforesaid charges. However it may bring in some concern from the debtor to be suddenly presented with a higher invoice and this may cause problems should the creditor later apply for a future contract with the debtor company. To try and prevent this from happening it would be best for a creditor that didn’t refer to the law to contact the debtor either by telephone or by personal appointment and courteously let then know that the invoice is overdue and they would not wish to have to make the charges that they are entitled to do by the law.
If this fails to stir the debtor into payment, then the creditor will need to use the Debt collection software in earnest and compose Debt collection letters, which should already be present in the Debt collection software as templates, ready to use once the debtor details are entered into the database. The creditor should be able to amend the Debt collection letters content to match their situation or relationship with the debtor, but they must resist using emotional wording as this will show them in an unprofessional light with the debtor. By using this process it is hoped that the debtor will be persuaded to settle the invoice and also settle up on time in the future.

When a small firm has done jobs for larger companies and one or more has renaged on the latest bills, the costs of dealing with this via solicitors skilled in Debt collection or Debt collection agencies can be high in comparison to the reserves available to the small firm. In these times the small firm may consider an internal approach where the purchase of Debt collection software can be a fraction of the solicitor or Debt collection business costs and so be an attractive approach. They will need to check out what is for sale on the market for a suitable package that comes with as many useful functions as possible for a fair price, nothing unusual there then.

Before taking this path, the small firm ought to really firstly check the contract for a late payment clause and consider following up on that. Without such a clause the “Late Payment of Commercial Debts (Interest) Act 2002” stipulates the late payment date as 30 days after the invoice is received for work done, or after the supply of equipment. If the invoice is still unsettled after this date the act allows the small firm to charge daily interest on the outstanding debt and also make a fixed one off charge to cover the costs of the Debt collection work. The small firm ought to in any event get hold of the large firm and find out why the invoice has not been paid as this can on occasion prove useful if there is a simple reason. It also shows the large firm that the small firm has an ethical and professional approach to business and does not use a shoot first ask questions later approach to payment difficulties.

If the payment issue can be sorted out from the communication, then that could be sufficient and there will be no need for Debt collection to be instigated. However if this does not sort out the issue and the small firm feels it has been poorly treated, they may well feel obliged to start Debt collection proceedings and start to use their Debt collection software.

The core to a Debt collection process is the use of Debt collection letters as these can put the small companys position into context with the act in force, but in a non-confrontational and certainly unemotional manner. This is likely to show that the small firm means business but is working in an ethical and professional manner. The Debt collection software ought to have either an on-line tutorial on the Debt collection process in general and Debt collection letters in particular, especially if the person delegated to use the Debt collection software has not been too involved in Debt collection in the past. A good suite of Debt collection software ought to be written around both the composing of Debt collection letters and also recording key happenings for the purpose of later providing evidence of the work that been done in the Debt collection process on this occasion. The reason for this is because if the large firm still does not pay the invoice then the small firm may need to take them to court and the court will want to see evidence of the small firm having made sufficient efforts to get the invoice paid before the case can be heard.
